Wills, Trusts and Probate

Wills

Whatever your requirements, stevensdrake can provide you with the Will you need.

We have decades of experience in drawing up both straightforward Wills and more complex Wills, such as those containing ongoing trusts.

We recognise that everyone’s circumstances and priorities are unique to them, which enables us to provide a highly tailored service to our clients

Administration of Estates

Dealing with the estate of a loved one is invariably a time-consuming and stressful experience and can often result in unforeseen complications. Throughout our long history, stevensdrake has administered countless estates, each with its own particular set of circumstances and challenges. What is more, we have the resources and expertise to act as an executor of your estate and as a trustee of any ongoing trusts in your Will.

Lasting Powers of Attorney

By signing a Lasting Power of Attorney, you can ensure that your financial affairs and/or your personal welfare needs are taken care of when you are no longer able to handle them yourself.

Our team has rapidly developed the expertise required to create Lasting Powers and to register them with the Office of the Public Guardian (which is a legal requirement, before a Lasting Power can actually be used).

Deputyship Applications

Needless to say, losing one’s mental capacity is both traumatic and life-changing. It also raises a multitude of practical problems. Even worse, for those without a valid Lasting or Enduring Power of Attorney in place, the only option available is for a relative, friend or professional to apply for a Deputyship Order (formerly known as a Mental Health Receivership Order). Unsurprisingly, this is a complicated and time-consuming process.

We, in the Private Client team, are here to help the applicant through the minefield of forms and procedure involved and to do so with expertise and sensitivity.

Tax Planning and Trusts

Using its expertise in capital taxes and trusts, the Private Client team is able to offer creative solutions tailored to your individual needs and circumstances. The team (in conjunction with our Business Law Department) also offers a full range of tax planning services to those with private business interests.

Contentious Probate and Trusts

It is an unfortunate fact of life that estates and trusts can, and often do, give rise to disputes. Our experienced Private Client team (working hand-in-hand with our Litigation Department) are there to help you through what can be an anxious and confusing time.

We are proud of our track record of settling disputes to the benefit of our clients. If, however, court proceedings become unavoidable our team (in conjunction with our Litigation colleagues) are fully equipped to represent our clients at all stages of proceedings.
