Litigation

Property litigation

Our team, which includes two members of the Property Litigation Association, act for a range of clients from individuals, small and medium businesses to multi-national corporations.    We can offer pro-active and clear advice and assistance on a range of disputes in the County Court, High Court, or Property Tribunal including,

  • Commercial contract disputes,
  • Partnership and shareholder disputes
  • Commercial and Residential Landlord & Tenant Disputes
  • Contentious Probate
  • Breach of trust
  • Professional negligence
  • Construction disputes
  • Motor Finance disputes
  • Boundary disputes
  • Recovery of goods
  • Breach of Intellectual Property rights
  • Breach of s106 Planning Agreements

Our dedicated property lawyers have a proven track record of assisting both landlords and tenants in relation to matters arising from the enforcement of leasehold obligations (including arrears of rent, recovery of possession, dilapidations, renewal, other breaches and enforcement against guarantors).   Our experience covers a broad spectrum of property types and extends to dealing with matters in the industrial, office and retail sector together with residential properties, and often requires us to work closely with surveyors and agents both locally and nationally.

We also have a successful track record in acting for land owners on the enforcement of easements, rights of way, and the demarcation of boundaries, and in providing advice in relation to the resolution of construction disputes, including claims in relation to the interpretation, application and enforcement of warranties.

We understand that every client requires a different approach to their dispute and therefore we are attuned  to the need of our clients who can be directed to the most appropriate form of dispute resolution, whether that is by proceeding with a claim through the court, arbitration, adjudication, mediation, early neutral evaluation, other expert determination or pre-action negotiation.

Whatever your circumstances we are able to advise on the most cost effective route with a view to providing the most practical and cost effective outcome using Alternative Dispute Resolution where appropriate to do so.
